Rights for Immigrants & Visa Holders

Constitutional Rights:

- Due Process Protections: Noncitizens cannot be deprived of life, liberty, or property without due process of law.

- Free Speech: Noncitizens possess rights to free speech and expression, meaning they cannot be targeted or deported solely for exercising peaceful speech.

- Right to Remain Silent: Anyone in the U.S. has the right to remain silent during encounters with law enforcement or immigration officers (ICE) and does not have to answer questions about their birthplace or immigration status.

- Protection from Unlawful Searches: Law enforcement and immigration agents generally need a judicial search warrant signed by a court (not just an administrative warrant) to enter private or non-public spaces without consent.
